- 6.08 You shall purchase our proprietary products from us or our Designated Supplier at a reasonable price established by us or our supplier. You acknowledge that we may profit from the sale of proprietary products to you and receive consideration from the supplier with respect to your purchases of such proprietary products by you.
- 6.09 During the Term of this Agreement, you shall (a) repair, maintain, and keep the interior and exterior of your Restaurant (and all fixtures, furnishings, signs, menu boards, equipment, sidewalks, walkways, and parking lots) in good order and first-class condition and repair and in compliance with the Standards and Specifications of the System and all applicable laws, rules, regulations, and ordinances, and (b) as reasonably required by us, upgrade your Restaurant to the then-current Standards and Specifications of the System. Such upgrade to renovate and modernize your Restaurant's building, premises, signs, and equipment shall be done at our request, but not more than once every five (5) years to conform to the building design, trade dress, color scheme, and presentation of our Trademarks consistent with the current image of Restaurants using the Beyond Juicery + Eatery System, provided, however, that the cost of each renovation and modernization shall not exceed one hundred thousand dollars ($100,000). You must renovate, repair, and alter the exterior and interior of your premises at your own expense as reasonably directed by us.

What This Means (2025 FDD)
The 2025 Franchise Disclosure Document for Beyond Juicery Eatery addresses the franchisee's responsibility to maintain their restaurant according to the brand's standards and applicable laws. Specifically, the franchisee must keep both the interior and exterior of the restaurant in good condition, complying with all standards, specifications, laws, rules, regulations, and ordinances. This includes maintaining fixtures, furnishings, signs, menu boards, equipment, sidewalks, walkways, and parking lots.
If Beyond Juicery Eatery requires renovations or repairs, the franchisee is responsible for completing them at their own expense. Should the franchisee fail to make the required renovations within 30 days of receiving written notice detailing the necessary repairs or alterations, Beyond Juicery Eatery has the right to complete the work themselves. This action does not constitute trespass, fault, or negligence on the part of the franchisor and does not waive any other remedies available to them.
In the event that Beyond Juicery Eatery undertakes the renovations or alterations, the franchisee is obligated to immediately reimburse Beyond Juicery Eatery for all costs incurred. Furthermore, the franchisee is required to indemnify and hold harmless Beyond Juicery Eatery, its franchisees, and affiliates from all fines, suits, proceedings, claims, demands, damages, liabilities, or costs, including actual attorneys' fees, arising from any failure to maintain the restaurant according to standards.
