What This Means (2025 FDD)

According to the 2025 Beyond Juicery Eatery Franchise Disclosure Document, the franchise agreement grants the franchisee the right to operate a single Beyond Juicery Eatery restaurant at a specific location, utilizing the Beyond Juicery Eatery system and trademarks, within a defined geographic area. This grant is subject to all the terms and conditions outlined in the franchise agreement and depends on the complete execution of the agreement by all parties involved. The agreement specifies that Beyond Juicery Eatery will not establish or authorize others to establish a restaurant within the franchisee's designated area during the initial term, provided there is no uncured event of default.

However, the agreement also stipulates several exceptions to the exclusivity of the designated area. Enclosed malls, institutions like hospitals and schools, airports, parks, casinos, and sports arenas are excluded from the designated area. Beyond Juicery Eatery retains the right to open other restaurants or franchise the right to open restaurants to others in these locations, regardless of their location or the name under which they operate. The specific details of the designated area and location are documented in an attachment to the franchise agreement.

Beyond Juicery Eatery also retains all rights concerning Beyond Juicery Eatery restaurants, trademarks, and the sale of similar or dissimilar products and services, allowing them to undertake any activities they deem appropriate, whenever and wherever they desire. This includes the right to sell products through various channels (such as third-party providers, vending, and online platforms) both inside and outside the franchisee's designated area, the right to operate businesses offering dissimilar products and services under the trademarks, and the right to operate Beyond Juicery Eatery restaurants outside the designated area under any terms and conditions. These stipulations highlight that while franchisees receive a defined territory, Beyond Juicery Eatery maintains considerable flexibility in its broader business operations and expansion strategies.
