To whom can the Franchisor assign the Assignment and its rights for a Beyond Juicery Eatery franchise?

Franchisor shall assume all of Franchisee's rights, options, and obligations under the Lease commencing upon the effective date of the assignment and Franchisor shall have the further right to transfer or assign the Lease to another Beyond Juicery + Eatery franchisee without the need to seek consent from Landlord.
If Franchisor assigns the Lease to another Beyond Juicery + Eatery franchisee, Franchisor shall be released from any further liability under the Lease.

What This Means (2025 FDD)
According to the 2025 Beyond Juicery Eatery Franchise Disclosure Document, the franchisor has the right to transfer or assign the lease to another Beyond Juicery + Eatery franchisee without needing consent from the landlord. If Beyond Juicery Eatery assigns the lease to another franchisee, Beyond Juicery Eatery is released from any further liability under the lease.
This means that if a franchisee defaults on their lease, Beyond Juicery Eatery has the option to take over the lease themselves. Beyond Juicery Eatery can then assign this lease to a new franchisee. This protects Beyond Juicery Eatery by allowing them to keep the location operating under the brand.
For franchisees in New York, the FDD stipulates that Beyond Juicery Eatery cannot transfer and assign its rights and obligations under the Franchise Agreement unless the transferee will be able to perform Beyond Juicery Eatery's obligations under the Franchise Agreement, in Beyond Juicery Eatery's good faith judgment, so long as it remains subject to the General Business Laws of the State of New York.
