What This Means (2025 FDD)
According to the 2025 Franchise Disclosure Document, the Franchise Agreement outlines specific rights retained by Beyond Juicery Eatery, which directly impact a franchisee's ability to engage with similar or competitive businesses. Beyond Juicery Eatery retains the right to establish, operate, and franchise similar businesses, offering similar or dissimilar products and services, under different trademarks both inside and outside a franchisee's designated area. This means that Beyond Juicery Eatery can operate or allow others to operate businesses that compete directly with a franchisee's location.
Beyond Juicery Eatery also has the right to sell goods and services identical or similar to those offered at Beyond Juicery Eatery restaurants through various channels of distribution, such as grocery stores, catering services, food trucks, and online platforms, both within and outside the franchisee's designated area. This includes the use of third-party delivery services. Furthermore, Beyond Juicery Eatery can acquire or be acquired by businesses that provide similar products and services, even if those businesses operate competitive businesses within a franchisee's designated area.
These provisions mean that a Beyond Juicery Eatery franchisee's territory is not exclusive in the sense that it prevents Beyond Juicery Eatery itself, or other businesses authorized by Beyond Juicery Eatery, from operating competing businesses nearby. A franchisee should be aware that Beyond Juicery Eatery retains considerable freedom to operate or license competing businesses, and a franchisee has no recourse to prevent this. This is a common practice in the franchise industry, where franchisors often retain rights to various distribution channels and business models to maximize brand reach and revenue.
