The Control Person shall be the person with whom we will communicate and upon whom we will rely on to bind the Franchisee. You authorize the Control Person to perform any and all actions on your behalf related to this Agreement. Any replacement of the Control Person shall be appointed by you within ten (10) days of the prior Control Person's resignation, termination, or death. If we conduct any training for the replacement Control Person, you shall pay to us all costs and expenses related to such training at the then-current rates for additional training, as well as expenses related to travel to attend the training.

  • 3.03 The requisite number of Managers, as we determine, shall be employed by you for your Restaurant. All Managers shall attend and successfully complete, to our satisfaction, our management training programs and be "certified" by us on an annual basis. At any time during the Term of this Agreement, your Franchisee Designate and at least three (3) certified Managers must be eligible to work in your Restaurant.

What This Means (2025 FDD)

According to the 2025 Beyond Juicery Eatery Franchise Disclosure Document, if Beyond Juicery Eatery conducts training for a replacement Control Person, the franchisee is responsible for all costs and expenses related to the training. These expenses are charged at the then-current rates for additional training.

In addition to the training fees, the franchisee must also cover expenses related to travel to attend the training. Beyond Juicery Eatery may also require the Control Person to attend additional training programs and seminars during the term of the agreement, for which the franchisee will be responsible for travel and living expenses, including employee wages, training expenses, and trainer expenses.

Beyond Juicery Eatery's current costs for additional assistance range from $250 to $1,000 per day per trainer, plus expenses. The franchisor retains the discretion to provide additional assistance and charge the franchisee for it, or to decline if a suitable assistant is unavailable. The franchisee is also responsible for conducting ongoing training programs for their employees as reasonably necessary.
