What This Means (2025 FDD)
According to the 2025 Beyond Juicery Eatery FDD, the franchisor retains specific rights regarding other concepts, even within a developer's designated area. Beyond Juicery Eatery has the right to operate or franchise others to operate businesses offering dissimilar products and services, both inside and outside the developer's designated area, under the trademarks and on any terms and conditions they deem appropriate. They also retain the right to acquire businesses providing similar products and services, even if those businesses (or their franchisees or licensees) are located in the developer's designated area.
Beyond Juicery Eatery also has the right to be acquired by a business providing similar products and services, or by another business, even if such business operates, franchises, and/or licenses competitive businesses in the developer's designated area. Additionally, Beyond Juicery Eatery has the right to allow third-party delivery service providers to deliver orders within the developer's designated area under any terms and conditions they deem appropriate.
This means that a Beyond Juicery Eatery developer's rights are limited to the specific Beyond Juicery Eatery restaurants they are authorized to develop. Beyond Juicery Eatery is not required to compensate the developer if they exercise any of these retained rights within the developer's designated area. This could potentially lead to competition within the developer's territory from other businesses or concepts affiliated with Beyond Juicery Eatery.
