What This Means (2025 FDD)
According to Beyond Juicery Eatery's 2025 Franchise Disclosure Document, the definition of Trade Secrets, a subset of Confidential Information, includes materials and techniques related to or used in the restaurant. This suggests that physical property and tangible items used in the business could be considered confidential information if they meet the criteria of a trade secret.
Specifically, information is considered a trade secret if it is not commonly known or available to the public, derives economic value from being kept secret, and is subject to reasonable efforts to maintain its secrecy. This definition encompasses a wide range of information, including materials, techniques, methods, and processes used in the restaurant's operations. Therefore, if certain property or equipment used by Beyond Juicery Eatery meets these criteria, it could be classified as confidential.
For a prospective franchisee, this means they must maintain the confidentiality of all materials, techniques, and processes provided by Beyond Juicery Eatery that are not publicly known. This obligation extends to protecting the secrecy of any unique equipment or methods used in the restaurant that give it a competitive advantage. Failure to maintain the confidentiality of such information could result in a breach of the franchise agreement.
