What This Means (2025 FDD)
The 2025 Franchise Disclosure Document for Beyond Juicery Eatery specifies that franchisees are responsible for maintaining their restaurants to a high standard. During the term of the agreement, the franchisee must keep both the interior and exterior of the restaurant, including all fixtures, furnishings, signs, menu boards, equipment, sidewalks, walkways, and parking lots, in good order and first-class condition and repair. This maintenance must comply with the standards and specifications of the Beyond Juicery Eatery system, as well as all applicable laws, rules, regulations, and ordinances.
Beyond Juicery Eatery can also require franchisees to upgrade their restaurants to meet the current system standards. These upgrades, which may include renovations and modernization of the building, premises, signs, and equipment, can be requested by Beyond Juicery Eatery, but not more than once every five years. The purpose of these upgrades is to conform to the building design, trade dress, color scheme, and presentation of the trademarks, ensuring consistency with the current image of Beyond Juicery Eatery restaurants. However, the cost of each renovation and modernization cannot exceed $100,000.
If a franchisee fails to make the required renovations within 30 days of receiving written notice from Beyond Juicery Eatery, the franchisor has the right to complete the repairs or alterations themselves. In such cases, the franchisee is responsible for immediately reimbursing Beyond Juicery Eatery for all costs incurred. Additionally, the franchisee must indemnify and hold Beyond Juicery Eatery, its franchisees, and affiliates harmless from any liabilities or costs, including attorney's fees, arising from the failure to maintain the restaurant according to the required standards.
While the FDD excerpt details the franchisee's responsibility to maintain and upgrade the restaurant's furniture, fixtures, and equipment, it does not explicitly state the conditions under which Beyond Juicery Eatery would purchase these items. A prospective franchisee should ask Beyond Juicery Eatery about any circumstances under which the franchisor might purchase the franchisee's furniture, fixtures, and equipment, such as in the event of a transfer, termination, or non-renewal of the franchise agreement.
