What This Means (2025 FDD)
According to the 2025 Beyond Juicery Eatery FDD, Beyond Juicery Eatery has the right to reasonably require franchisees to upgrade their restaurants to meet the system's current standards and specifications. This includes renovations and modernizations to the building, premises, signs, and equipment. These upgrades are to conform to the building design, trade dress, color scheme, and presentation of the trademarks to maintain consistency with the current image of Beyond Juicery Eatery restaurants. However, Beyond Juicery Eatery can only request such an upgrade once every five years.
The FDD stipulates that the cost of each renovation and modernization should not exceed $100,000. Franchisees are responsible for renovating, repairing, and altering both the exterior and interior of their premises at their own expense, as reasonably directed by Beyond Juicery Eatery. If a franchisee fails to make the required renovations within 30 days of receiving written notice detailing the necessary repairs or alterations, Beyond Juicery Eatery has the right to complete the repairs or alterations themselves to maintain the restaurant in accordance with the required standards.
If Beyond Juicery Eatery undertakes the renovations, the franchisee must immediately reimburse Beyond Juicery Eatery for all costs incurred. Furthermore, the franchisee is responsible for indemnifying and holding Beyond Juicery Eatery, its franchisees, and affiliates harmless from any liabilities, costs, or damages, including attorney's fees, arising from these renovations. This clause ensures that Beyond Juicery Eatery maintains control over brand standards and image while placing the financial responsibility for maintaining and upgrading the restaurant on the franchisee, within the specified limitations.
