Under certain circumstances, after the first 60 days of operation, we may allow you to appoint a designated manager ("Designated Manager") who has been approved by us, to run the day-to-day operations of the Beverly Ann's Business. The Designated Manager must successfully complete our Beverly Ann's Culinary Class training program (See Item 11). The Designated Manager need not have an ownership interest in the Beverly Ann's Business. If you replace a Designated Manager for any reason, the new Designated Manager must satisfactorily complete our Beverly Ann's Culinary Class training program at your own expense.

What This Means (2025 FDD)
According to Beverly Anns Cookie's 2025 Franchise Disclosure Document, a franchisee is generally required to manage their Beverly Ann's Cookie franchise through a Managing Owner who has at least 51% ownership and voting power in the business entity. This Managing Owner must actively supervise and participate in the daily operations of the business. To ensure active involvement, Beverly Ann's Cookie requires the franchisee or Managing Owner to be an active owner and operator for the first 60 days of operation.
However, under certain circumstances, Beverly Anns Cookie may allow a franchisee to appoint a Designated Manager to handle the day-to-day operations after the initial 60-day period. This Designated Manager does not need to have an ownership interest in the business.
To qualify as a Designated Manager, the individual must be approved by Beverly Anns Cookie and successfully complete the Beverly Ann's Culinary Class training program. If a franchisee replaces a Designated Manager, the new manager must also complete the training program at the franchisee's expense. This policy allows for some flexibility in the operational management of the franchise while ensuring that the business is run by someone with adequate training and approval from Beverly Anns Cookie.
