What standards must a Beverly Anns Cookie franchisee comply with?

We grant you a non-exclusive license to own and operate a single Franchised Business using the business formats, methods, procedures, signs, designs, standards, specifications, distinguishing elements, and intellectual property (the "System") that we authorize strictly in compliance with the terms and conditions set forth in this Franchise Agreement, within the Territory or other areas we may specify in Attachment A to this Franchise Agreement. You recognize and acknowledge the distinctive significance to the public of the System and Marks and acknowledge and understand our high and uniform standards of quality, appearance and service to the value of the System. You acknowledge that we may change, improve or otherwise modify the System as we deem appropriate in our discretion, and you agree to promptly accept and comply with any such changes, improvements or modifications. You agree that our ability to require Beverly Ann's Cookie Truck franchisees to make significant changes to their GR Vehicle (and any Additional Equipment) is critical to our ability to administer and change the System and to maintain the Beverly Ann's Cookie Truck brand's image of cleanliness, efficiency and quality. You agree to proactively maintain, modify, repair and upfit your GR Vehicle (and any Additional Equipment) over time to meet our standards. Currently, you will be required to update the GR Vehicle as follows: (1) every seven years; (2) upon the execution of successor franchise agreement for a Beverly Ann's Cookie Truck franchise with a GR Vehicle that has not completed the required remodels or is not in compliance with current standards; (3) upon the transfer of a Franchised Business with a GR Vehicle that has not completed the required remodels; or (4) for a GR Vehicle that is not in compliance with current standards. You must use our approved supplier for the window tinting, wrapping and upfitting of your GR Vehicle which could be us or our affiliates. You will be required to purchase a new GR Vehicle depending on age, condition and wear of the GR Vehicle, but no later than 28 years after its manufacture from us or our affiliates.
We may periodically create advertising and sales promotion programs and materials to enhance the collective success of all Beverly Ann's Cookie Truck franchisees operating under the System. You must conduct and participate in promotional campaigns (the "Promotions") which may from time to time be required, and you must conduct and participate in those Promotions in accordance with our policies and procedures. This may include requiring you to offer free products to customers on certain days or providing coupons (not to exceed $500 per year unless authorized by the Council, if established). The value of Promotions you must offer may be increased at any time upon super-majority (75%) of the Council, if established, and upon 30 days' notice to you, but will not exceed $1,500 per calendar year.
You agree, at your sole cost and expense, to issue and offer such rebates, giveaways, and other promotions in accordance with advertising programs established by us, and further agree to honor the rebates, giveaways, and other promotions issued by other Beverly Ann's Cookie Truck franchisees under any such program, so long as such compliance does not contravene any applicable law, rule, or regulation. You will not create or issue any gift cards/certificates and will only sell gift cards/certificates that have been issued or sponsored by us and which are accepted at all franchised businesses, and you will not issue coupons or discounts of any type except as approved by us.

According to Beverly Anns Cookie's 2025 Franchise Disclosure Document, franchisees must adhere to specific standards related to the System, Marks, and the GR Vehicle. Franchisees must also maintain the GR Vehicle (either the Grandma's Recipe Motor Vehicle or Trailer) to meet Beverly Ann's Cookie's standards for cleanliness, efficiency, and quality. Significant changes to the GR Vehicle may be required to maintain the brand's image. Franchisees are responsible for proactively maintaining, modifying, repairing, and upfitting their GR Vehicle to meet these standards. The GR Vehicle must be updated every seven years, upon the execution of a successor franchise agreement, or upon the transfer of a Franchised Business if the GR Vehicle does not meet current standards. New GR Vehicles must be purchased no later than 28 years after manufacture.
Additionally, franchisees must participate in promotional campaigns as required by Beverly Anns Cookie, following their policies and procedures. Franchisees must honor rebates, giveaways, and other promotions issued by other franchisees, provided such compliance does not violate any applicable laws. Franchisees are restricted from creating or issuing their own gift cards/certificates and may only sell those issued or sponsored by Beverly Anns Cookie. Compliance with these standards ensures uniformity and quality across all Beverly Anns Cookie franchises, protecting the brand's reputation and customer experience.
