Can Beverly Anns Cookie restrict a franchisee from attending conventions, and if so, under what conditions?

According to the 2025 Beverly Anns Cookie Franchise Disclosure Document, Beverly Anns Cookie does reserve the right to restrict franchisees from attending national or regional conferences. These conferences are held to discuss business issues, operational concerns, and general business matters affecting Beverly Ann's Cookie Truck franchisees. While attendance at these conferences may be mandatory or optional, Beverly Ann's Cookie retains the authority to restrict a franchisee's attendance.

Beverly Anns Cookie may base its decision to restrict attendance on factors such as a franchisee's past performance, previous defaults, and other considerations, all evaluated at Beverly Ann's Cookie's sole discretion. This means that a franchisee who has a history of not meeting performance standards or who has previously defaulted on their franchise agreement could be barred from attending these conferences.

If a franchisee is permitted to attend these conferences, they are responsible for paying the then-current conference fee. Additionally, the franchisee is responsible for all expenses incurred by their trainees for all training and conferences, including wages, travel, lodging, food, and living expenses. Furthermore, the franchisee agrees to reimburse Beverly Ann's Cookie for all expenses and costs incurred by Beverly Ann's Cookie to travel to the franchisee's business, including travel, food, lodging, and living expenses.
