Beverly_Anns_Cookie Franchise · 2025 FDD

Answer from 2025 FDD Document

Each direct and indirect owner (i.e., each person holding a direct or indirect ownership interest in your entity) of the Franchisee entity must sign a "Franchise Owner Agreement," the form of which is attached to the Franchise Agreement as Attachment C. We also require that the spouses of the Beverly Ann's Cookie Franchise owners sign the Franchise Owner Agreement. The Franchise Owner Agreement extends the obligations of the Franchise Agreement to each owner and their spouse with each owner and spouse bound to and liable for the terms of the Franchise Agreement.

What This Means (2025 FDD)

According to the 2025 Beverly Anns Cookie Franchise Disclosure Document, each direct and indirect owner of the franchisee entity must sign a Franchise Owner Agreement. This agreement extends the obligations of the Franchise Agreement to each owner. Additionally, Beverly Anns Cookie requires that the spouses of the Beverly Ann's Cookie franchise owners also sign the Franchise Owner Agreement.

This requirement ensures that all individuals with a financial stake in the franchise, as well as their spouses, are legally bound to the terms and conditions outlined in the Franchise Agreement. By having all owners and their spouses sign the Franchise Owner Agreement, Beverly Anns Cookie aims to protect its brand, system standards, and confidential information. This also ensures that all parties are liable for upholding the terms of the agreement.

For a prospective Beverly Anns Cookie franchisee, this means that before the franchise can be established, all individuals with ownership interests, no matter how small, and their spouses must be willing to sign the Franchise Owner Agreement. This is a common practice in franchising, as it provides an extra layer of security for the franchisor and ensures that all parties involved are fully aware of their obligations and responsibilities. Franchisees should carefully review the Franchise Owner Agreement and understand its implications before signing.
