Controlling Agreement.
This Agreement supplements and modifies other agreements that you may have with Eagle Financial Services, Inc.
To the extent that this Agreement and another agreement contain conflicting provisions, the provisions in this agreement will control (with the exception of provisions in another agreement for an electronic service which provisions specify the necessary hardware, software and operating system, in which such other provision controls).
All other obligations of the parties remain subject to the terms and conditions of any other agreement.

What This Means (2025 FDD)
According to Beverly Anns Cookie's 2025 Franchise Disclosure Document, the Electronic Signature Agreement supplements and modifies other agreements a franchisee may have with Eagle Financial Services, Inc. This agreement allows franchisees to sign documents electronically, consenting to receive communications electronically, including notices, disclosures, statements, data, records, and loan documents.
If there are conflicting provisions between the Electronic Signature Agreement and another agreement with Eagle Financial Services, Inc., the provisions in the Electronic Signature Agreement will generally take precedence. An exception exists for provisions in other agreements related to electronic services that specify necessary hardware, software, and operating system requirements; those provisions will control over the Electronic Signature Agreement.
However, all other obligations of both parties remain subject to the terms and conditions outlined in any other agreements. Franchisees can request paper versions of electronic communications from Eagle Financial Services, Inc., and they have the right to withdraw their consent to receive electronic communications at any time, although Eagle Financial Services, Inc. reserves the right to restrict or terminate electronic access if consent is withdrawn.
