Answer from 2025 FDD Document

We offer franchises ("Beverly Ann's Franchise(s)" or "Franchise(s)") for the use of our "Beverly Ann's Cookie" trademarks, trade names, service marks, and logos ("Marks") for the operation of Beverly Ann's Businesses. Beverly Ann's Businesses are operated under our proprietary Beverly Ann's system ("System"). The System may be changed or modified by us throughout your ownership of the Franchise. Beverly Ann's Businesses operate mobile businesses which includes the GRM and GRT and other mobile units that sell cookies, ice cream and related products. Customers can also book the GRM or GRT or other mobile units for various events, including fundraising events, sports leagues, school events or sports, festivals and fairs, birthday parties, corporate events, picnics, church events, block parties, daycares and preschools, etc. You must use the GRM and GRT only for the operation of the Beverly Ann's Business and only to sell the products that we authorize. We may allow certain franchisees to operate an additional Beverly Ann's Business operated at a fixed location within their territory ("Fixed Location Business"). Franchisees will sign the then-current Fixed Location Amendment, a sample is attached to this Franchise Disclosure Document in Exhibit H. Franchisees also have the option to purchase "Additional Equipment" (See Item 6).

What This Means (2025 FDD)

According to Beverly Anns Cookie's 2025 Franchise Disclosure Document, the Beverly Ann's system is subject to change or modification during the franchise term. The FDD states that Beverly Ann's Businesses are operated under their proprietary system, and this system may be changed or modified by them throughout the franchisee's ownership of the Franchise. This means that Beverly Anns Cookie has the right to alter various aspects of the business model, potentially impacting how franchisees operate.

This flexibility allows Beverly Anns Cookie to adapt to changing market conditions, introduce new products or services, and update operational procedures. For a franchisee, this could mean changes to the menu, required equipment, marketing strategies, or even the overall brand image. While such changes could be beneficial, they also carry the risk of increased costs or operational challenges as franchisees adapt to the new requirements.

Prospective franchisees should consider the implications of these potential changes and inquire about the types of modifications that have been implemented in the past, as well as the process by which Beverly Anns Cookie communicates and implements these changes. Understanding the scope and frequency of potential changes can help franchisees prepare for the evolving nature of the Beverly Anns Cookie business model and assess their ability to adapt accordingly. It is important to note that the franchisee must use the GRM and GRT only for the operation of the Beverly Ann's Business and only to sell the products that Beverly Anns Cookie authorizes.
