11. BRAND FUND
The Brand Fund is used to promote public awareness of our brand and to improve our System. You are required to pay the Brand Fund Contribution. The Brand Fund may be administered by us or our affiliate or designees, at our discretion. We may use the Brand Fund for any expenditure that we, in our sole discretion, deem necessary or appropriate to promote or improve the System or the Beverly Ann's Cookie Truck brand. We may incorporate the Brand Fund or operate it through a separate entity whenever we deem appropriate.

What This Means (2025 FDD)
According to the 2025 Beverly Anns Cookie FDD, information regarding the Brand Fund can be found on page 81. The Brand Fund is used to increase public awareness of the Beverly Anns Cookie brand and to improve the franchise system.
As a franchisee, you are required to contribute to the Brand Fund. Beverly Anns Cookie, or its affiliates or designees, manages the Brand Fund and has the sole discretion to use the fund for expenditures deemed necessary or appropriate to promote or improve the Beverly Ann's Cookie system or brand.
Beverly Anns Cookie retains the right to incorporate the Brand Fund or operate it through a separate entity if deemed appropriate. This gives Beverly Anns Cookie flexibility in how they manage and utilize the Brand Fund, but it also means that the franchisee may not have direct control over how the funds are spent.
