We grant you a non-exclusive license to own and operate a single Franchised Business using the business formats, methods, procedures, signs, designs, standards, specifications, distinguishing elements, and intellectual property (the "System") that we authorize strictly in compliance with the terms and conditions set forth in this Franchise Agreement, within the Territory or other areas we may specify in Attachment A to this Franchise Agreement. You recognize and acknowledge the distinctive significance to the public of the System and Marks and acknowledge and understand our high and uniform standards of quality, appearance and service to the value of the System. According to Beverly Anns Cookie's 2025 Franchise Disclosure Document, the company has the right to modify the System as it deems appropriate and franchisees must promptly comply with these changes. This means Beverly Anns Cookie can change various aspects of the franchise operations, and franchisees are obligated to implement these changes.
Beverly Anns Cookie may also modify the content of and/or discontinue the System Website at any time in its sole discretion. The company is only required to reference a franchisee's Franchised Business on its System Website while the franchisee is in full compliance with the Franchise Agreement and all System standards.
These stipulations grant Beverly Anns Cookie broad authority to adapt its business model and operational standards. For a prospective franchisee, this means they must be prepared to adapt their business practices to align with changes implemented by Beverly Anns Cookie. Failure to comply with these changes could result in the franchisee not meeting System standards, which could affect their standing with the company and their presence on the System Website.
