- NO FURTHER CHANGES. Except as specifically provided in this Amendment, all of the terms, conditions and provisions of the Franchisee Agreement will remain in full force and effect as originally written and signed. In the event of any inconsistency between the Franchise Agreement and this Amendment, this Amendment shall control.

What This Means (2025 FDD)
According to the 2025 Beverly Anns Cookie Franchise Disclosure Document, the Franchise Disclosure Questionnaire cannot be signed or dated on the same day as the receipt for the Franchise Disclosure Document. However, it must be signed and dated on the same day the franchisee signs the Franchise Agreement.
This requirement ensures that prospective Beverly Anns Cookie franchisees have had sufficient time to review the Franchise Disclosure Document (FDD) before completing the questionnaire. The questionnaire is designed to confirm that the franchisee understands the terms of the franchise agreement and has had the opportunity to seek professional advice.
It is important to note that the Franchise Disclosure Questionnaire is not to be used for any franchise sale in or to residents of California, Hawaii, Illinois, Indiana, Maryland, Michigan, Minnesota, New York, North Dakota, Rhode Island, South Dakota, Virginia, Washington, or Wisconsin. Additionally, the questionnaire should not be signed if the franchisee is a resident of Maryland or if the franchise is to be operated in Maryland.
