Advisory Council
We may form, change, merge or dissolve an advisory council ("Council") at any time, in our sole discretion, to advise us on advertising policies and to promote communications between us and all franchisees. Any such Council will be governed by bylaws that will specify that members of the Council would consist of both franchisees and franchisor representatives and will specify how members are selected, subject to any changes to such bylaws or structure we deem necessary in our sole discretion. Any Council would serve in an advisory capacity only. If we appoint you to the Council, you agree to join, participate in, and actively support the Council. Your Brand Fund Contributions may be increased or decreased at any time upon super-majority (75%) approval of the Council, upon 30 days' notice to you. We may grant the Council any operation or decision-making powers we deem appropriate.

What This Means (2025 FDD)
According to Beverly Anns Cookie's 2025 Franchise Disclosure Document, E-Lead Fees are non-refundable. If a franchisee elects to use Beverly Ann's Cookie's digital marketing service (the "E-Lead Program"), they must pay an E-Lead Fee. The fee is currently $250 for E-Lead Lite or $500 for E-Lead Plus.
The E-Lead Fee is paid when the franchisee enrolls in the E-Lead Program and annually on the anniversary of their enrollment. While participation in the E-Lead Program is currently optional, Beverly Anns Cookie retains the right to mandate enrollment in the future with 60 days' written notice.
Beverly Anns Cookie also reserves the right to discontinue the E-Lead Program, increase fees and costs, or revise the terms and conditions at any time and at their sole discretion. However, regardless of any changes to the program or a franchisee's decision to un-enroll, the E-Lead Fees already paid remain non-refundable.
