Bevaris_Alliance Franchise · 2024 FDD

Answer from 2024 FDD Document

  • (b) Transmission of an executed counterpart of this agreement (but for the avoidance of doubt not just a signature page) or the executed signature page of a counterpart of this agreement] by (a) fax or (b) email (in PDF, JPEG or other agreed format) shall take effect as delivery of an executed counterpart of this agreement. If either method of delivery is adopted, without prejudice to the validity of the agreement thus made, each party shall provide the others with the original of such counterpart as soon as reasonably possible thereafter.

What This Means (2024 FDD)

According to the 2024 Bevaris Alliance Franchise Disclosure Document, if an executed counterpart or signature page of the agreement is transmitted by fax or email, each party must provide the others with the original counterpart as soon as reasonably possible. This requirement does not invalidate the agreement made through fax or email transmission.

This means that while Bevaris Alliance allows for the convenience of transmitting the agreement via fax or email to expedite the process, it still requires the exchange of original documents. This is a fairly standard practice in franchising and business transactions, as original documents often carry more legal weight and can be important for record-keeping purposes.

Therefore, as a prospective Bevaris Alliance franchisee, you should be prepared to send the original signed agreement even after sending a copy via fax or email. This ensures full compliance with the franchise agreement and avoids any potential disputes regarding the authenticity of the agreement.
