- 4.18 Noncompliance Fee: In the event the Franchisee is in noncompliance with clause 7, Franchisor, may, in its sole discretion, assess Franchisee the Noncompliance Fee.
5. Franchisor's initial obligations
The Franchisor shall within 45 days of the date of this agreement or at least 14 days before the Commencement Date provide:
- (a) general advice on how to set up the Franchisee's Business;
- (b) the Manual by computer link and/or Zip File;
- (c) the Franchise Software on the terms of the license set out in the Manual or otherwise provide by Franchisor to Franchisee;
- (d) A list of Food Service Agreements as of the date of this agreement;
6. Franchisor's continuing obligations
The Franchisor shall at all times during the Term:
(a) provide the Franchisee with know-how, advice and guidance relating to the Branded Business;

What This Means (2024 FDD)
According to Bevaris Alliance's 2024 Franchise Disclosure Document, within 45 days of the franchise agreement date, or at least 14 days before the commencement date, Bevaris Alliance will provide a list of Food Service Agreements to the franchisee.
These Food Service Agreements are significant because the franchisee must operate their Bevaris Alliance business in accordance with them. The franchisee is obligated to comply with the terms of these agreements, as well as the franchise agreement itself and the operations manual.
Furthermore, Bevaris Alliance is responsible for seeking renewals of existing Food Service Agreements and securing new ones. However, Bevaris Alliance retains the right to select any franchisee for the performance of a Food Service Agreement and can replace a selected franchisee with another or even provide the products and services directly.
