Can the Individual assign their rights or obligations under the Bevaris Alliance agreement?

According to the 2024 Bevaris Alliance Franchise Disclosure Document, the Individual, who is a party to the franchise agreement, is restricted from assigning their rights or obligations under the agreement. Specifically, the FDD states that the Individual may not assign or transfer any of his rights or obligations under this agreement.

This restriction is in place to ensure that the Individual remains committed to the Bevaris Alliance franchise and fulfills their responsibilities, such as guaranteeing the franchisee's performance and devoting full-time attention to the franchisee's business. The Individual's role includes assuring the franchisee performs all obligations, being a director/officer/managing member of the franchisee, and holding more than 50% of the franchisee's voting capital.
