What This Means (2024 FDD)

According to the 2024 FDD, if the Expert initially appointed to make a determination for Bevaris Alliance dies, becomes unwilling or incapable of acting, or fails to deliver a decision within the required timeframe, either party (franchisee or franchisor) can apply to a court of competent jurisdiction to discharge the Expert. The court can then appoint a replacement Expert with the required expertise.

Once a replacement Expert is appointed, the same rules and procedures that applied to the first Expert will also apply to the new Expert. This ensures continuity and fairness in the expert determination process. The new Expert is bound by the same requirements regarding decision timelines, language, and access to information.

This clause protects both the franchisee and Bevaris Alliance by ensuring that a fair and impartial expert determination can still occur even if the original expert is unable to fulfill their duties. It provides a mechanism for resolving disputes efficiently and fairly, without being stalled by unforeseen circumstances affecting the original expert.
