What This Means (2024 FDD)

According to Bevaris Alliance's 2024 Franchise Disclosure Document, if the appointed Expert is unable or unwilling to fulfill their duties, or fails to deliver a decision within the stipulated timeframe, either Bevaris Alliance or the franchisee has the right to take action. Specifically, either party can apply to a court of competent jurisdiction, as defined in clause 27.15, to request the removal of the Expert.

Furthermore, the same court can be petitioned to appoint a replacement Expert who possesses the necessary expertise to handle the matter. This ensures that the dispute resolution process can continue without undue delay or obstruction. The newly appointed Expert will then be subject to the same terms and conditions as the original Expert, ensuring consistency and fairness in the determination process.

This clause provides a safeguard for both Bevaris Alliance and its franchisees, ensuring that the expert determination process can proceed even if the initial Expert is unable to complete their assignment. By allowing either party to seek court intervention, the agreement prevents one party from being unfairly disadvantaged due to the Expert's inability to act. This mechanism helps maintain the integrity and enforceability of the franchise agreement.
