Is a Bevaris Alliance franchisee's right to use copyrighted materials limited by any agreement?

Your right to use or license copyrighted materials (such as the Manual) are not materially limited by any agreement or known infringing use. You must tell us immediately if you learn about an infringement or challenge to your use of our copyrighted materials. Bevaris will take the action that we think appropriate. You must also agree not to contest our interest in copyrighted materials or our other trade secrets. If we decide to add, modify or discontinue the use of an item or process covered by a patent or copyright, you must also do so. Our sole obligation is to reimburse you for the tangible cost of complying with this obligation. Although we are not obligated to defend your use of these items or processes, Bevaris will reimburse you for damages and reasonable costs incurred in litigation about them. All documentation provided to you by us, including our Manual, advertising and promotional materials, and any other materials shall be afforded all applicable protections under the United States Copyright Act of 1976, as amended.

What This Means (2024 FDD)
According to the 2024 Bevaris Alliance Franchise Disclosure Document, a franchisee's right to use or license copyrighted materials is not materially limited by any agreement or known infringing use. However, the franchisee must immediately inform Bevaris Alliance if they become aware of any infringement or challenge to their use of the franchisor's copyrighted materials. Bevaris Alliance will then decide on the appropriate action to take.
Furthermore, as a Bevaris Alliance franchisee, you must agree not to contest the franchisor's interest in copyrighted materials or trade secrets. If Bevaris Alliance decides to add, modify, or discontinue the use of an item or process covered by a patent or copyright, the franchisee is obligated to comply. In such cases, Bevaris Alliance will only reimburse the franchisee for the tangible cost of complying with this obligation.
While Bevaris Alliance is not obligated to defend the franchisee's use of these items or processes, they will reimburse the franchisee for damages and reasonable costs incurred in litigation about them. All documentation provided by Bevaris Alliance, including the Manual, advertising, promotional materials, and any other materials, are protected under the United States Copyright Act of 1976, as amended.
