What This Means (2024 FDD)
According to the 2024 Bevaris Alliance Franchise Disclosure Document, the franchisee is responsible for the safe custody and maintenance of the operations manual. The franchisee must keep the manual in good condition at their own risk until it is either returned to Bevaris Alliance or destroyed at Bevaris Alliance's discretion, as outlined in clause 19.3 of the franchise agreement.
This obligation ensures that franchisees properly protect and preserve the confidential and proprietary information contained within the manual. The manual contains critical details about the Bevaris Alliance system, including operational procedures, brand standards, and intellectual property. By requiring franchisees to maintain the manual in good condition, Bevaris Alliance aims to prevent the loss, theft, or misuse of this information, which could harm the brand and its franchisees.
The franchisee bears the risk of loss or damage to the manual, highlighting the importance of secure storage. The manual remains the exclusive property of Bevaris Alliance, and the franchisee's right to possess and use it is tied to the franchise agreement. Upon termination of the franchise agreement, the franchisee must either return the manual to Bevaris Alliance or destroy it if instructed to do so.
This requirement is standard practice in franchising, as franchisors need to protect their intellectual property and ensure consistent brand standards across all franchise locations. Franchisees should understand that the operations manual is a valuable asset and must be handled with care to comply with the terms of the franchise agreement.
