The Franchisor may select any franchisee for performance of a Food Service Agreement. After a franchisee is selected for a particular Food Service Agreement, the Franchisor may replace the selected franchisee with another franchisee or itself provide the Products and Services directly under the Food Service Agreement.

What This Means (2024 FDD)
According to Bevaris Alliance's 2024 Franchise Disclosure Document, Bevaris Alliance has the right to replace a franchisee selected for a Food Service Agreement. The document states that after a franchisee is initially chosen to fulfill a Food Service Agreement, Bevaris Alliance retains the authority to replace that franchisee with another franchisee.
This clause also allows Bevaris Alliance to directly provide the products and services outlined in the Food Service Agreement themselves. This means that even after a franchisee has been assigned a Food Service Agreement, Bevaris Alliance can reassign the agreement to another franchisee or take over the responsibilities themselves.
For a prospective franchisee, this indicates a potential risk. While a franchisee may secure a Food Service Agreement, there is no guarantee they will maintain it. Bevaris Alliance has the power to reassign the agreement, which could impact the franchisee's expected revenue and business operations. It is important for potential franchisees to understand the conditions under which Bevaris Alliance might exercise this right and to assess the potential impact on their investment and business plan.
