- 13.6 Failure to insure. If the Franchisee fails to take out and maintain such policies, the Franchisor may do so and the Franchisee shall reimburse the Franchisor for all costs and expenses incurred in doing so.
14. Premises
The Franchisee shall comply with the terms, conditions, covenants and undertakings to be observed and performed by the Franchisee under the Food Service Agreements and without prejudice to the provisions of the Food Service Agreements shall:
- (a) operate the Franchisee's Business only from the Premises or as otherwise called for under a Food Service Agreement and/or as reasonably directed by the Franchisor;
- (b) at its own expense equip and keep the Premises as required by the Franchisor and in accordance with the Manual and the Food Service Agreements and to the highest standards in the industry;
- (c) not carry out any alterations to the Premises without the Franchisor's landlord and owner's prior written consent;
- (d) keep the Premises clean and maintain hygiene and safety standards as required by the Franchisor, its landlord and owner, and as specified in the Manual and keep fixtures and fittings in working order;
- (e) ensure that all signs required to be displayed by the Franchisor at the Premises;
- (f) use only insignia, symbols, brand names, trade names or trademarks at the Premises that are approved by the Franchisor and specified in the Manual;
- (g) keep the Premises open during the hours required by the Franchisor and as set forth in the Food Service Agreements, the Franchisee's Landlord and owner, and specified in the Manual;

After a franchisee is selected for a particular Food Service Agreement, the Franchisor may replace the selected franchisee with another franchisee or itself provide the Products and Services directly under the Food Service Agreement.
