What This Means (2024 FDD)
According to the 2024 Bevaris Alliance Franchise Disclosure Document, clause 19.3 dictates the destruction of the manual. The franchisee is responsible for keeping the manual in good condition until it is either returned to Bevaris Alliance or destroyed at Bevaris Alliance's discretion. This clause ensures that the franchisee understands the manual remains the intellectual property of the franchisor.
This requirement is fairly standard in franchising. Franchise systems rely heavily on their operations manuals to maintain consistency and quality across all locations. By retaining the right to demand the return or destruction of the manual, Bevaris Alliance ensures that franchisees do not continue to operate using outdated or unauthorized information, especially after the franchise agreement terminates.
For a prospective Bevaris Alliance franchisee, this means understanding that the operations manual is a critical document that must be safeguarded and updated as directed by the franchisor. Failure to comply with this requirement could potentially lead to breaches of the franchise agreement.
