What This Means (2024 FDD)
According to the 2024 Bevaris Alliance Franchise Disclosure Document, in California, no statement, questionnaire, or acknowledgement signed by a franchisee regarding the franchise relationship can waive claims under state franchise law, including fraud, or disclaim reliance on franchisor statements. This provision overrides any conflicting terms in any document related to the franchise. This means that the franchisee is protected by California franchise law, and the franchise agreement cannot supersede these protections.
This addendum ensures that franchisees in California retain their rights and protections under state law, regardless of what other documents might state. It specifically prevents Bevaris Alliance from enforcing waivers of claims or disclaimers of reliance that would otherwise undermine the franchisee's legal standing. This is a significant benefit for franchisees, as it provides an additional layer of security and recourse in case of disputes or misrepresentations.
This type of state-specific addendum is common in franchise agreements, as state laws vary and often provide additional protections to franchisees. Prospective Bevaris Alliance franchisees in California should carefully review this addendum to understand their rights and how it affects their relationship with the franchisor. It is also advisable to consult with a legal professional to fully understand the implications of this provision and how it interacts with the rest of the franchise agreement.
