What standards must a Better Blend franchisee follow when constructing or remodeling the location?

Franchisee shall submit its proposed Location to BBF for acceptance, with all related information and documents BBF may request. If BBF does not accept the proposed Location in writing within 30 days, then it is deemed rejected. When BBF accepts the Location, it will issue a Location Acceptance Letter in the form of Attachment 2 which states the Location and Territory. BBF shall determine the Territory in its good faith discretion, substantially in accordance with Item 12 of the Franchise Disclosure Document. BBF's advice regarding or acceptance of a proposed Location is not a representation or warranty that the Business will be successful, or that the Business is permitted to be operated at the Location under applicable laws or zoning ordinances, and BBF has no liability to Franchisee with respect to the location of the Business.
- 6.2 Lease. In connection with any lease between Franchisee and the landlord of the Location: (i) if requested by BBF, Franchisee must submit the proposed lease to BBF for written approval, (ii) the term of the lease (including renewal terms) must be for a period of not less than the term of this Agreement, and (iii) Franchisee shall use commercially reasonable efforts to obtain the landlord's signature to a rider to the lease in the form required by BBF.
- 6.3 Development. Franchisee shall construct (or remodel) and finish the Location in conformity with BBF's System Standards. If required by BBF, Franchisee shall engage the services of an architect licensed in the jurisdiction of the Location. Franchisee shall not begin any construction or remodeling work without first obtaining BBF's approval of Franchisee's plans, and without first obtaining any required permits or licenses necessary to commence such construction or remodeling work. Franchisee must engage a qualified licensed general contractor to perform such construction or remodeling work. BBF may, but is not required to, inspect Franchisee's construction or remodeling progress at any reasonable time. Franchisee shall not rely upon any information provided or opinions expressed by BBF or its representatives regarding any architectural, engineering, or legal matters (including without limitation the Americans With Disabilities Act) in the development and construction of the Business, and BBF assumes no liability with respect thereto. BBF's inspection and/or approval to open the Business is not a representation or a warranty that the Business has been constructed in accordance with any architectural, engineering, or legal standards.
- 6.4 New Franchisee Training. Franchisee's Principal Executive and a general manager must complete BBF's training program for new franchisees to BBF's satisfaction at least four weeks before opening the Business.
- 6.5 Conditions to Opening. Franchisee shall notify BBF at least 30 days before Franchisee intends to open the Business to the public.

What This Means (2024 FDD)
According to Better Blend's 2024 Franchise Disclosure Document, franchisees must construct or remodel their location in accordance with Better Blend's System Standards. Franchisees must submit their proposed location to Better Blend for acceptance, including all related information and documents that Better Blend may request. If Better Blend does not accept the proposed location in writing within 30 days, it is deemed rejected. Upon acceptance, Better Blend will issue a Location Acceptance Letter.
Better Blend may advise franchisees regarding the layout, design, and build-out of the business to the extent they deem appropriate. Franchisees are required to engage a qualified, licensed general contractor for any construction or remodeling work. Franchisees cannot begin any construction or remodeling work without first obtaining Better Blend's approval of their plans and securing all necessary permits and licenses.
Better Blend has the option, but is not obligated, to inspect the franchisee's construction or remodeling progress at any reasonable time. Franchisees are also responsible for maintaining the business in a neat and clean condition, performing all necessary maintenance, and keeping all property of the business in good repair. Any alterations or replacements to the interior or exterior of the business must comply with all applicable System Standards or receive prior approval from Better Blend.
