What This Means (2024 FDD)
According to Better Blend's 2024 Franchise Disclosure Document, the franchisee is responsible for repaying any costs incurred by Better Blend in attempting to collect payments owed by the franchisee or to enforce any other provision of the Franchise Agreement. This includes, without limitation, reasonable attorney fees. This means that if a Better Blend franchisee fails to make payments or violates the Franchise Agreement, they will be responsible for covering Better Blend's expenses in pursuing collection or enforcement actions.
This provision is fairly standard in franchise agreements, as it ensures that the franchisor can recover costs associated with enforcing the agreement and collecting debts. It is important for prospective franchisees to understand that non-compliance with the agreement can lead to financial penalties beyond the original debt or obligation. The franchisee's obligation to pay these costs is not dependent on Better Blend's performance and is considered an independent covenant.
For a prospective Better Blend franchisee, this means that it is crucial to adhere to the terms of the Franchise Agreement and make all payments on time to avoid incurring additional costs. Failing to do so could result in significant financial burdens, as the franchisee would be responsible for Better Blend's attorney fees and other expenses related to collection and enforcement efforts. This clause underscores the importance of understanding and complying with all aspects of the Franchise Agreement to maintain a positive and financially sound relationship with Better Blend.
