What This Means (2024 FDD)
According to Better Blend's 2024 Franchise Disclosure Document, the franchisee bears sole responsibility for the consequences arising from the improper operation, maintenance, and upgrading of their technology. This includes acquiring, operating, maintaining, and upgrading the technology, ensuring it interfaces correctly with Better Blend's and third-party systems, and adhering to data security standards and privacy laws.
This allocation of responsibility means that if the franchisee's technology fails to meet required standards or causes issues, they are liable for any resulting damages or losses. This could involve financial repercussions, such as fines for non-compliance with data security standards, or operational disruptions if the technology malfunctions and affects business operations. The franchisee is also responsible for ensuring their technology complies with the Payment Card Industry Data Security Standards and all laws governing the use, disclosure, and protection of Privacy Information.
For a prospective Better Blend franchisee, this highlights the importance of investing in reliable technology and ensuring it is properly managed and updated. Franchisees should budget for ongoing technology maintenance and upgrades, and they may want to consider engaging IT professionals to assist with these tasks. Additionally, franchisees should carefully review and understand all technology-related requirements outlined by Better Blend to avoid potential compliance issues and associated penalties.
