What This Means (2024 FDD)
According to Better Blend's 2024 Franchise Disclosure Document, if you are a franchisee in Illinois, the franchise agreement cannot designate jurisdiction and venue in a forum outside of Illinois. However, the franchise agreement can allow arbitration to occur outside of Illinois. This information is found in the Illinois Rider to the Franchise Agreement.
This means that if a Better Blend franchisee in Illinois has a legal dispute with the company that is litigated in court, the lawsuit must take place within the state of Illinois. However, if the dispute is handled through arbitration, the arbitration proceedings can occur outside of Illinois. Arbitration is a common method of dispute resolution in franchising, where a neutral third party hears both sides of the argument and makes a binding decision.
This provision protects Illinois franchisees by ensuring they are not forced to travel to another state to resolve legal disputes with Better Blend. It also ensures that Illinois law will be applied to the agreement. Franchisees should consult with an attorney to fully understand their rights and obligations under the Illinois Franchise Disclosure Act.
