If Better Blend conducts an inspection, can they speak with employees and customers?

hange, add or delete System Standards at any time in its discretion. BBF may inform Franchisee thereof by any method that BBF reasonably deems appropriate (which need not qualify as "notice" under Section 18.9). In the event of any dispute as to the contents of the Manual, BBF's master copy will control.
- 11.2 Inspections. BBF may enter the premises of the Business from time to time at any reasonable time (including during normal business hours) and conduct an inspection. Franchisee shall cooperate with BBF's inspectors. BBF will use reasonable efforts to not disrupt Franchisee's
business operations during any such inspection. The inspection may include, but is not limited to, observing operations, conducting a physical inventory, evaluating physical conditions, monitoring sales activity, speaking with employees and customers, and removing samples of products, supplies and materials. BBF may videotape and/or take photographs of the inspection and the Business. BBF may set a minimum score requirement for inspections, and Franchisee's failure to meet or exceed the minimum score will be a default under this Agreement. Without limiting BBF's other rights under this Agreement, Franchisee will, as soon as reasonably practical, correct any deficiencies noted during an inspection. If BBF conducts an inspection because of a governmental report, customer complaint or other customer feedback, or a default or non-compliance with any System Standard by Franchisee (including following up a previous failed inspection), then BBF may charge all out-of-pocket expenses plus its then-current inspection fee to Franchisee.

What This Means (2024 FDD)
According to Better Blend's 2024 Franchise Disclosure Document, Better Blend has the right to conduct inspections of the franchise location. As part of these inspections, Better Blend is explicitly permitted to speak with both employees and customers. This allows Better Blend to gather information about the operations, customer service, and overall quality of the franchise.
Better Blend will use reasonable efforts to minimize disruption to the franchisee's business operations during inspections. These inspections can include observing operations, conducting physical inventories, evaluating the physical condition of the premises, monitoring sales activity, and even removing samples of products, supplies, and materials for further evaluation. Better Blend also reserves the right to videotape or take photographs during the inspection.
Better Blend may set a minimum score requirement for inspections, and failure to meet or exceed this score can result in a default under the Franchise Agreement. Franchisees are expected to promptly correct any deficiencies noted during an inspection. If an inspection is triggered by a governmental report, customer complaint, or a franchisee's failure to comply with System Standards, Better Blend may charge the franchisee for all out-of-pocket expenses and its then-current inspection fee.
Furthermore, Better Blend is authorized to communicate directly with a franchisee's employees and contractors on any matter related to the Better Blend system or the specific franchise business. Franchisees cannot prohibit their employees or contractors from communicating with Better Blend. This open line of communication ensures that Better Blend can maintain oversight and address any issues that may arise within the franchise network.
