What This Means (2024 FDD)
According to the 2024 Better Blend Franchise Disclosure Document, the Guarantor's obligation to maintain confidentiality survives the termination or expiration of the Franchise Agreement indefinitely. The Guarantor must adhere to Better Blend's security procedures, disclose confidential information to employees only when necessary for business operation, and avoid using the information in any unauthorized manner. They must also make every effort to maintain confidentiality and promptly report any unauthorized disclosure or use of confidential information.
The Guarantor acknowledges that all customer data collected by the business and data from the point-of-sale system (excluding employee data) is Better Blend's confidential information. This obligation extends indefinitely beyond the termination or expiration of the franchise agreement.
This indefinite confidentiality clause means that even after the franchise relationship ends, the Guarantor remains legally bound to protect Better Blend's confidential information. This is a standard practice in franchising to protect the brand's proprietary information and competitive advantage.
