What This Means (2024 FDD)
According to Better Blend's 2024 Franchise Disclosure Document, a franchisee must comply with any reasonable instructions and procedures from Better Blend for de-identification. This requirement is specifically in relation to the removal of Better Blend's branding from the location after termination or expiration of the franchise agreement.
Within 30 days after the termination or expiration of the franchise agreement, the franchisee is responsible for de-identifying the location at their own expense. This involves removing all Better Blend marks, signage, and trade dress to the reasonable satisfaction of Better Blend.
If the franchisee fails to de-identify the location within the specified 30-day period, Better Blend has the right to enter the location and remove the marks and de-identify the location themselves. In such cases, Better Blend will not be held liable for trespass or be required to compensate the franchisee for any assets removed, altered, or any damages caused during the de-identification process.
This clause ensures that upon termination or expiration of the franchise agreement, the franchisee takes the necessary steps to disassociate the location from the Better Blend brand, preventing any potential confusion or misuse of the brand's identity. Compliance with Better Blend's instructions is mandatory, and failure to comply can result in Better Blend taking action to protect its brand and image.
