What cooperation is required of a Better Blend franchisee in the event of a Data Security Event?

According to Better Blend's 2024 Franchise Disclosure Document, a franchisee has specific obligations in the event of a Data Security Event. A "Data Security Event" includes any actual or suspected act, whether internal or external, that compromises the security of the business's technology, violates security policies, or involves unauthorized access, disruption, or changes to the system.

In the event of a Data Security Event, the Better Blend franchisee must immediately notify Better Blend upon becoming aware of the event. Furthermore, the franchisee is required to cooperate with Better Blend and follow all reasonable requests from Better Blend to address the Data Security Event. This cooperation includes efforts to protect any Privacy Information and/or Confidential Information that may be at risk.

Better Blend, or its designated representative, retains the right, but not the obligation, to take any action or pursue any legal proceedings related to the Data Security Event. This means that while Better Blend may take the lead in addressing the event, the franchisee is still responsible for providing the necessary cooperation and assistance as requested. This clause highlights the importance of franchisees having robust data security measures in place and being prepared to act swiftly and in coordination with Better Blend in the event of a security breach.
