What This Means (2024 FDD)
According to Better Blend's 2024 Franchise Disclosure Document, Better Blend Franchising, LLC (BBF) has the authority to modify or waive System Standards for individual franchises. This flexibility is permitted due to specific factors such as the unique characteristics of the location, population density, potential business opportunities, the population of the trade area, existing business practices, relevant laws and regulations, or any other condition that could impact the performance of a franchise or group of franchises.
This clause in the franchise agreement provides Better Blend with the discretion to adapt its standard operating procedures to suit the specific circumstances of each franchise location. For example, a Better Blend franchise in a densely populated urban area might be allowed to adjust its marketing strategies or store layout to better cater to the local customer base, whereas a rural location might require different adaptations.
However, the FDD stipulates that a franchisee is not automatically entitled to the same variations or waivers granted to other franchisees. This means that even if one Better Blend franchise receives a special exception due to its location's unique circumstances, another franchisee cannot demand the same exception. This ensures that Better Blend maintains control over its System while still allowing for necessary adjustments based on individual franchise needs. Prospective franchisees should consider this when evaluating the franchise agreement, understanding that System Standards can be modified, but not necessarily for every location.
