What This Means (2024 FDD)

According to Better Blend's 2024 Franchise Disclosure Document, Better Blend Franchising, LLC (BBF) has extensive access rights to a franchisee's technology used in the operation of their Better Blend business. Specifically, BBF is granted "unlimited access" to the franchisee's technology. This access can be exercised through any means designated by Better Blend.

This provision means that Better Blend can monitor and inspect the technology systems used in the franchise. This includes hardware, software, and any other technology-related components essential for running the Better Blend business. The franchisee is obligated to provide this access, ensuring that Better Blend can oversee operations, maintain system standards, and protect the brand's integrity.

While Better Blend maintains these access rights, the franchisee retains sole responsibility for acquiring, operating, maintaining, and upgrading their technology. The franchisee is also responsible for how their technology interfaces with Better Blend's systems and any third-party systems. Additionally, the franchisee is accountable for any consequences resulting from the improper operation, maintenance, or upgrading of their technology. The franchisee must also comply with the Payment Card Industry Data Security Standards and all laws governing the use, disclosure, and protection of privacy information.

This arrangement is fairly common in franchising, where franchisors need to ensure brand consistency and operational standards across all locations. However, the breadth of access and the franchisee's responsibility for all related issues highlight the importance of carefully selecting and managing technology systems within the Better Blend franchise.
