- D.
If the President and Chief Executive Officer or his designee, upon receipt of Member's written answer, determines that the violations originally charged do not exist, have been satisfactorily corrected, or will be corrected within the prescribed corrective period, no further action on the part of the Member or Best Western is required.
In the event the Member does not correct the charged violations within the prescribed corrective period and notify Best Western in writing of such event, or if the charged violations have not been corrected to Best Western's satisfaction, then the President and Chief Executive Officer or his designee shall give notice to the Member by traceable expedited carrier, that grounds for cancellation exist.
The notice shall contain:
Statement of the specific violation that has not been satisfactorily corrected;
Statement of the facts upon which the violation charged is based;
Source: Item 23 — Receipts (FDD pages 108–413)
What This Means (2025 FDD)
According to Best Western's 2025 Franchise Disclosure Document, if the President and Chief Executive Officer (or their designee) determines, upon receiving a member's written answer, that the initially charged violations either do not exist, have been satisfactorily corrected, or will be corrected within the allotted time, then no further action is required from either the member (franchisee) or Best Western. This signifies a resolution of the issue at hand.
However, if the Best Western member fails to correct the violations within the specified timeframe and notify Best Western in writing, or if Best Western is not satisfied with the corrections made, the President and Chief Executive Officer (or their designee) will issue a notice to the member. This notice, sent via a traceable expedited carrier, will inform the member that grounds for cancellation of the membership exist.
The notice of cancellation will include a statement of the specific violation that has not been satisfactorily corrected and a statement of the facts upon which the violation is based. This process ensures that Best Western provides clear communication and an opportunity for franchisees to rectify any issues before more severe actions, such as cancellation, are taken.
