What This Means (2025 FDD)

According to the 2025 Best Western Franchise Disclosure Document, the Best Western agreement automatically renews for successive 120-month terms unless either Best Western or the member provides written notice of intent not to renew. This notice must be given at least 12 months prior to the end of the then-current term.

For a prospective franchisee, this means that if you or Best Western decide not to continue the franchise agreement, you must provide written notice a year before the current term expires. Failing to do so will result in an automatic renewal for another 120-month (10-year) term. This requirement ensures both parties have ample time to prepare for the end of the agreement and allows for a smooth transition.

However, the FDD also states that for memberships governed by Minnesota law, Best Western will comply with Minn. Stat. Sec. 80C.14, Subds. 3, 4 and 5, which require 180 days' notice of non-renewal of the agreement. This clause indicates that franchisees in Minnesota have different notification requirements than franchisees in other states. Franchisees in Washington should also be aware that RCW 19.100.180 may supersede the agreement in regards to termination and renewal.
