There are no currently effective material determinations of the USPTO, the United States Copyright Office, or a court regarding the copyrighted materials. There are no agreements that significantly limit our rights to use or license the use of the copyrighted or proprietary materials. There is no provision in the Franchise Agreement specifically obligating us to protect your rights to use of the proprietary or copyrighted materials, but we will respond to this information as we deem appropriate. There are no infringing uses known to us which would materially affect your use of the proprietary and/or copyrighted materials.

According to Best Brains' 2025 Franchise Disclosure Document, there are no currently effective material determinations from the USPTO, the United States Copyright Office, or any court regarding the copyrighted materials. Best Brains and its affiliates claim copyright protection of their Operations Manual and related materials, even though these materials have not been registered with the United States Registrar of Copyrights.
Best Brains considers the Operations Manual and related materials proprietary and confidential, and they remain the property of Best Brains and its affiliates. Franchisees are permitted to use these materials only as outlined in the Franchise Agreement. Franchisees must not use Best Brains' confidential information in any unauthorized way and must take reasonable steps to prevent its disclosure to others.
During the franchise term, franchisees are entitled to use the copyrighted and proprietary materials. Additionally, there are no agreements that significantly limit Best Brains' rights to use or license the use of the copyrighted or proprietary materials. While the Franchise Agreement does not specifically obligate Best Brains to protect a franchisee's rights to use the proprietary or copyrighted materials, Best Brains states that it will respond to this information as it deems appropriate.
