What releases must a Best Brains franchisee execute to renew the franchise agreement?

According to the 2025 Best Brains Franchise Disclosure Document, a franchisee (and their owners, if the franchisee is an entity) must execute releases to renew their franchise agreement. These releases must be in a form satisfactory to Best Brains, and they must cover any and all claims against Best Brains, its affiliates, and their respective officers, directors, managers, shareholders, members, employees, and agents.

It is important to note that the franchise agreement and ancillary agreements at the time of renewal may contain materially different terms from those in the original agreement. Failure to sign these agreements and releases within thirty (30) days after delivery will be deemed an election not to renew the franchise. The franchisee must also pay a renewal fee as specified in Section 2.G of the franchise agreement.

However, there is an exception to this requirement for franchisees in North Dakota. According to the North Dakota Addendum to the Franchise Agreement, franchisees in North Dakota are not required to sign a release upon renewal of the franchise agreement. This addendum takes precedence over any conflicting terms in the standard franchise agreement, ensuring that North Dakota franchisees are not subject to the release requirement.
