- If we determine, in our sole discretion, that you do not pass the training program, we shall have the right to terminate this Agreement, effective upon delivery of written notice to you. We will not be liable to return any franchise fee or pay any costs or expenses incurred by you if we terminate this Agreement because you do not pass the training program
