any new, amended, restated, extended or renewed lease for the Franchised Business will include the above terms and conditions.

- Subletting. You shall not lease or sublet all or any part of the business premises to others or use any portion of the premises for any purpose other than conducting business pursuant to this Agreement without our prior written consent.

- Relocation. If you want to relocate the Franchised Business, you must notify us in writing at least 60 days prior to the relocation. We reserve the right to refuse to approve a proposed relocation if we believe for any reason that the proposed relocation is not acceptable.
Our judgment may be based on factors such as the proximity to existing or proposed locations owned by other franchisees or us, the suitability of the proposed facilities, compliance with ours then current franchise location requirements, and the competitiveness within the marketplace or other factors.

What This Means (2025 FDD)
According to Best Brains' 2025 Franchise Disclosure Document, prior to a lease renewal, Best Brains must review and approve the lease renewal. This approval is contingent upon the lease including terms acceptable to Best Brains, such as those required in a lease for a location as specified in the Franchise Agreement.
As a condition of approving the lease renewal, Best Brains may require the franchisee to remodel, modernize, and redecorate the premises to reflect Best Brains' current standards and image. Upon receiving a request for lease renewal, Best Brains will provide the franchisee with a written notice of any deficiencies related to the image, appearance, decoration, furnishings, equipment, and stocking of the franchised business. The notice will also include a schedule for upgrading or modifying the business to comply with Best Brains' current standards.
The Best Brains franchisee is responsible for the fee for Best Brains' services related to the lease renewal and the evaluation of necessary upgrades, up to $3,500. This fee covers the costs incurred by Best Brains and is due upon the execution of the lease renewal.
