All bank accounts, licenses, permits or other similar documents must contain the actual name of the person or entity owning the Franchised Business and may contain "d/b/a BEST BRAINS."

Best Brains requires franchisees to operate their franchised business in accordance with the company's Operations Manual, which may be amended periodically. Franchisees must adhere to these amendments and make necessary expenditures within the timeframes established by Best Brains. Best Brains may implement a system of non-compliance fees for violations of the Operations Manual policies, such as employees not wearing proper attire.

Furthermore, Best Brains mandates that franchisees purchase and maintain specific insurance coverage during the term of the agreement. This includes workers' compensation, comprehensive public liability and property damage, business interruption, and general and umbrella coverages. Franchisees must maintain coverage under policies with terms, conditions, and minimum liability protection amounts specified by Best Brains, issued by approved insurance carriers. These policies must name Best Brains as an additional insured, waive subrogation rights against the company, and provide thirty days' advance written notice of termination, expiration, cancellation, or modification. Franchisees must provide evidence of insurance and premium payments to Best Brains prior to opening and annually thereafter. If a franchisee fails to maintain the required insurance, Best Brains reserves the right to obtain such insurance on their behalf, with the franchisee responsible for reimbursing all associated premiums and expenses.
