- E. Advertising. We shall direct all advertising and marketing programs financed by the Brand Development Fund. We will have with sole discretion over the creative concepts, materials and endorsements used and the geographic, market, and media placement of the advertisements. We will provide you with approved advertising and marketing materials on the same terms and conditions as other BEST BRAINS businesses.

What This Means (2025 FDD)
According to Best Brains' 2025 Franchise Disclosure Document, Best Brains, Inc. has sole discretion over the advertising and marketing programs financed by the Brand Development Fund. This includes the creative concepts, materials, and endorsements used in advertisements. They also control the geographic, market, and media placement of these advertisements.
This means that as a Best Brains franchisee, you will not have control over the advertising campaigns run using the Brand Development Fund. Best Brains, Inc. decides how these funds are spent and what kind of advertising is used. While franchisees contribute to the Brand Development Fund, Best Brains, Inc. is not obligated to ensure that expenditures in a specific market are proportionate to the franchisee's contributions.
Franchisees are provided with approved advertising and marketing materials under the same terms as other Best Brains businesses. However, franchisees are allowed to submit their own advertising material for approval, and if written approval is not received within fourteen days of receipt of the materials by Best Brains, the advertising will be deemed to have been disapproved.
