What This Means (2025 FDD)
According to the 2025 Bens Soft Pretzels Franchise Disclosure Document, the Captive Venue Addendum grants the franchisee the right to operate one store at the authorized location. However, the franchisee acknowledges that they will not have any exclusive or protected territory and are prohibited from selling outside of the authorized location. This addendum modifies the original Franchise Agreement to account for the captive venue nature of the authorized location.
This means that a Bens Soft Pretzels franchisee operating under a Captive Venue Addendum has a very limited scope of operation. Their business is confined to a specific location, such as an airport, stadium, or shopping mall, without the ability to expand beyond that venue. This differs significantly from a traditional franchise agreement where franchisees often have a protected territory to develop and market their business.
The franchisee's commencement date of operations is contingent upon written authorization from Bens Soft Pretzels and the franchisee fulfilling all other established requirements. Prospective franchisees should carefully consider the implications of operating within a captive venue, including the reliance on foot traffic within that location and the lack of control over the venue's management and policies. They should also inquire about any specific requirements or restrictions imposed by the venue operating partner, as these can further impact their business operations.
