ization at least 15 days prior to the next billing date. If the above noted periodic payment dates fall on a weekend or holiday, I understand that the payment may be executed on the next business day. I understand that because this is an electronic transaction, these funds may be withdrawn from my account as soon as the above noted periodic transaction dates. In the case of an ACH Transaction being rejected for Non Sufficient Funds (NSF) I understand that Ben's Soft Pretzels, LLC may at its discretion attempt to process the charge again within 30 days, and agree to an additional $25 charge for each attempt returned NSF which will be initiated as a separate transaction from the authorized recurring payment. I acknowledge that the origination of ACH transactions to my account must comply with the provisions of U.S. law. I agree not to dispute this recurring billing with my bank so long as the transactions correspond to the terms indicated in this authorization form.

What This Means (2025 FDD)

According to the 2025 Bens Soft Pretzels Franchise Disclosure Document, if an ACH transaction is rejected due to Non-Sufficient Funds (NSF), Bens Soft Pretzels, LLC may attempt to process the charge again within 30 days. If this occurs, the franchisee will incur an additional $25 charge for each NSF attempt. This $25 charge will be initiated as a separate transaction from the authorized recurring payment.

Additionally, if any amount due from the Subtenant is not received by the Sublessor within five days after the due date, or within five days after receipt of written notice from the Sublessor if no due date is specified, the Subtenant will pay an additional sum of six percent (6%) of the overdue amount as a late charge. This late charge is considered a fair and reasonable estimate of the costs the Sublessor will incur due to the late payment.

Furthermore, all amounts not paid to the Sublessor when due will bear interest from the due date until paid at a rate of one and one-half percent (1.5%) per month until paid. This interest accrual underscores the importance of timely payments to avoid additional financial burdens. Franchisees should ensure they have sufficient funds and maintain accurate account information to prevent NSF charges and late payment penalties.
